These terms apply to the mobile games and applications published by Global Surat ("Global Surat", "we", "us" or "our") on Google Play, the Apple App Store and other app stores (each an "App" and together the "Apps"). By downloading, installing or using an App, you agree to these terms. If you do not agree, please do not use the Apps.
Your use of the Apps is also subject to the terms of the app store you downloaded them from. How we handle your information is explained in our App Privacy Policy.
1. Who can use the Apps
You may use the Apps if you are old enough to agree to these terms where you live, or if a parent or legal guardian has agreed to them for you. If you are a parent or guardian allowing a child to use an App, you are responsible for their use of it, including any purchases, and you can use your device's parental controls to manage their access.
2. Your licence to use the Apps
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to download and use the Apps on devices you own or control, for your own non-commercial entertainment, in line with these terms and the app store's rules. The Apps are licensed to you, not sold. We and our licensors keep all rights not expressly granted to you.
3. Fair play
To keep the Apps fair and working for everyone, you agree not to:
copy, modify, decompile, reverse engineer or create derivative works of an App, except where the law expressly allows it;
use cheats, hacks, bots, automation, modified versions or any unauthorised third-party software to gain an advantage or alter the App;
exploit bugs or glitches, or fail to report them when you find one that gives an unfair advantage;
interfere with how ads are delivered or measured, or generate invalid ad activity, for example by clicking ads automatically, repeatedly or on someone else's behalf;
attempt to access our systems, servers or other players' data without permission;
rent, sell, sublicense or commercially exploit an App or anything in it; or
use an App in any way that breaks the law or infringes the rights of others.
If you break these rules, we may reset your progress, remove rewards, restrict features or stop you from using the App.
4. Advertising
The Apps are free to use because they show advertising. Ads are provided by third parties, including Google AdMob, and may appear as banners, full-screen ads between levels or videos. By using the Apps you accept that ads will be shown.
Rewarded ads. Some Apps let you choose to watch an ad in return for an in-game reward, such as an extra life, a hint or coins. Rewards are granted only when the ad has been watched to the end. Ads may not always be available, and we do not guarantee that a rewarded ad will be offered at any particular time.
Advertisers' content. The products and services shown in ads are offered by the advertisers, not by us. We do not endorse them and are not responsible for their content, accuracy or any dealings you have with an advertiser.
Personalisation. Whether ads are personalised depends on your consent choices and device settings, as explained in the App Privacy Policy.
5. In-app purchases and virtual items
The Apps do not currently offer in-app purchases. If we introduce them, the following terms will apply.
How purchases work. Purchases are made through the app store you use and are subject to its payment terms. Prices are shown in the store before you confirm a purchase, including any applicable taxes.
Virtual items. Virtual currency, items, levels, boosts and other in-game content, whether earned or bought, are part of your licence to use the App. They have no real-world monetary value, cannot be exchanged for cash or anything of value outside the App, cannot be transferred to anyone else, and may be changed, rebalanced or removed as the game develops.
Random items. If an App offers randomised virtual items for purchase, we will show the odds of receiving each item before you buy.
Subscriptions. If an App offers a subscription, it will renew automatically at the end of each period unless you cancel it in your app store account settings at least 24 hours before renewal. The price, period and what is included will be shown before you subscribe.
Refunds. All purchases are final, except as required by law or permitted by the app store's refund policy. Refund requests are handled by the app store, for example through Google Play or the Apple App Store.
Delivery problems. If you paid for something that did not arrive in the App, contact us with your order number and we will investigate.
6. Game progress and data
Unless an App offers cloud saves, your progress, scores and virtual items are stored on your device. They may be lost if you uninstall the App, clear its data, change devices or reset your device, and we may not be able to restore them.
7. Updates and availability
We may update the Apps to fix bugs, add or change features, rebalance gameplay or meet the requirements of app stores and the law. Some updates may be needed to keep using an App. We may also stop supporting a device or operating system, or withdraw an App from sale. Some features need an internet connection, and your mobile operator may charge you for data.
8. Health and safety
A very small number of people may experience seizures when exposed to certain flashing lights or patterns, including those in video games. If you or anyone in your family has an epileptic condition, consult a doctor before playing. Stop playing immediately if you feel dizzy, have altered vision, eye or muscle twitches, disorientation or any involuntary movement. Take regular breaks, play in a well-lit room, and stay aware of your surroundings while using the Apps.
9. Intellectual property
The Apps and everything in them, including code, artwork, characters, music, sound effects, text and trade marks, are owned by Global Surat or our licensors and protected by intellectual property laws. Nothing in these terms gives you any right to use them other than to play the Apps as allowed here.
10. Third-party services
The Apps rely on services provided by others, such as the app stores, Google Play services, Google AdMob and Firebase. Your use of those services is subject to their own terms and privacy policies, and we are not responsible for them.
11. Disclaimer
The Apps are provided for entertainment and are made available "as is" and "as available". To the fullest extent permitted by law, we do not promise that the Apps will be uninterrupted, error-free or compatible with every device, or that defects will always be corrected. Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Global Surat is not liable for any indirect, incidental, special or consequential loss, or for any loss of data, progress, virtual items, profits or goodwill, arising from your use of or inability to use the Apps. Our total liability to you for any claim relating to the Apps is limited to the greater of the amount you paid us for the App concerned in the twelve months before the claim, or USD 50 (or its equivalent in your local currency).
Nothing in these terms limits liability that cannot be limited by law, or affects your statutory rights as a consumer.
13. Ending your use
You can stop using an App at any time by uninstalling it. We may suspend or end your access to an App if you seriously or repeatedly break these terms, if we are required to by law, or if we withdraw the App. The sections of these terms that by their nature should continue, such as those on intellectual property, disclaimers and liability, continue after your use ends.
14. Additional terms for Apple devices
If you download an App from the Apple App Store, you also acknowledge that:
these terms are between you and Global Surat only, not Apple, and Global Surat, not Apple, is solely responsible for the App and its content;
Apple has no obligation to provide maintenance or support for the App;
if the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price you paid for the App, and, to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App;
Global Surat, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, consumer protection claims and intellectual property infringement claims;
you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and you are not on any US Government list of prohibited or restricted parties; and
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
15. Changes to these terms
We may update these terms from time to time, for example when we add features such as in-app purchases. We will change the "Last updated" date at the top of this page and, for significant changes, let you know in the App or its store listing. If you keep using the Apps after the changes take effect, the updated terms apply.
16. Governing law
These terms are governed by the laws of India, and the courts at Surat, Gujarat, India have jurisdiction over any dispute relating to them. If you use the Apps as a consumer, you also keep the protection of any mandatory laws of the country where you live, and you may bring proceedings in your local courts.
